USE IS SUBJECT OF THE DEMOLITION PERMIT, ANY
ASSOCIATED ACCESSORY STRUCTURE/USE MUST ALSO BE
DEMOLISHED AND/OR TERMINATED UNLESS WRITTEN
PERMISSION STATING OTHERWISE IS PROVIDED BY THE
PLANNING DEPARTMENT. THE GROWTH MANAGEMENT
DIVISION RESERVES THE RIGHT TO REQUIRE THAT
REMAINING DEVELOPMENT BE BROUGHT INTO COMPLIANCE
THROUGH THE PROPER APPROVAL PROCESS OR TERMINATED
UPON FUTURE DISCOVERY. IT IS RECOMMENDED THAT IF

PLANNING APPROVAL FOR HOUSE DEMO/REMOVE
WOOD/DEBRIS OF HOUSE.
DOCK AND GAZEBO TO REMAIN.
AT 1273 ROGERS LN, CUDJOE KEY, SUBJECT TO THE
FOLLOWING CONDITIONS:
Planning Department approval for demolition of a
principal structure, with accessory structure(s)
proposed to remain, as per the scope of work
described in the building permit application.
Subject to the following conditions:
1. The application has been reviewed for
consistency with the text amendments to the Monroe
County Land Development Code Sections 102-58,
134-26 and 134-27 (Ordinance 009-2019). Permit
applications relying on these sections will not be
eligible for issuance until the code change goes
into effect.
Pursuant to Land Development Code Section 102-58:
Nonconforming Accessory Uses and Accessory
Structures. (a) A nonconforming accessory use
shall not continue after the principal use has
terminated. (b) A nonconforming accessory
structure shall not continue after the principal
use or structure is demolished or otherwise
eliminated unless the structure is modified to
conform to the provisions of the land use (zoning)
district in which it is located and is associated
with a new principal use. (c) Notwithstanding
subsection (a) and (b), when a principal structure
and/or use is discontinued or removed as a result
of damage from a man-made or natural disaster,
lawfully established accessory structures
associated with the discontinued use may remain
with approval from the Planning Director pursuant
to Sections 134-26 and 134-27.
Pursuant to Land Development Code Section 134-27:
Notwithstanding the definition of Accessory use or
accessory structure in Section 101-1 and the
provisions of Section 102-58, Nonconforming
Accessory Uses and Accessory Structures, when a
principal structure and/or use is discontinued or
removed as a result of damage from a man-made or
natural disaster, lawfully established accessory
structures associated with the discontinued use
may remain with approval from the Planning
Director if all of the following criteria are met:
1. The principal structure is determined to be a
lawfully established dwelling unit per Section
138-22; 2. The lawfully established accessory
structure is conforming to all other provisions of
the Land Development Code; and 3. IN THE ABSENCE
OF AN ACTIVE CONCURRENT PERMIT FOR REDEVELOPMENT
OF A PRINCIPAL USE OR STRUCTURE ON THE SITE, THE
ACCESSORY STRUCTURE MAY REMAIN FOR UP TO FIVE (5)
YEARS FROM THE DATE OF THE DISASTER EVENT.
2. This permit is for the demolition of a
principal use or structure. Approval of this
permit does not imply approval of any future
development. Pursuant to Land Development Code
Section 110-37 in order to reestablish a principal
use or structure an applicant for development
approval shall submit an application for a
building permit.
3. Approval of this permit does not deem all
remaining development as conforming and does not
provide any vesting to existing regulations.
4. Any future development must be in compliance
with all applicable regulations of the Monroe
County Land Development Code and Comprehensive
Plan in effect at the time of development
approval.
5. THE ACCESSORY USES ALLOWED TO REMAIN VIA THIS
PERMIT HAVE NOT BEEN REVIEWED FOR LAWFULNESS OR
COMPLIANCE WITH CURRENT LAND DEVELOPMENT CODE
REQUIREMENTS. Upon filing of permit applications
in the future for the replacement of a principal
structure, a survey and site plan will be required
to verify that the remaining accessory structures
meet the requirements of the current land
development code. Upon detailed review at that
time, some or all of the accessory structures
allowed to remain on site under this permit may
need to be modified or removed if they do not meet
the requirements of the current code.
6. The Planning & Environmental Resources
Department reserves the right to require that all
development be brought into compliance through the
proper approval process or terminated upon future
discovery.
7. Any deviations shall require prior Planning
approval.
8. No other work this permit.
9. Work not specified in this application may not
be carried out without additional prior Planning
and Building Department approval(s).
10. Work in right-of-way requires separate permit.
