Hurricane Irma Emergency Permit
A thorough inspection of the structures on the
parcel will be conducted in the near future to
make a determination of total damage. The issuance
of this permit does not guarantee future permits
will be issued, if the damage assessment
inspection and substantial damage/substantial
improvement calculator determine that the
structure was substantially damaged as a result of
Hurricane Irma.
Should a structure be damages more than 50% of its
adjusted building value (Monroe County Property
Appraiser Market Value + 20%), the structure will
not be permitted to be repaired or improved unless
it is fully compliant with the Monroe County
Floodplain Management Ordinance, Chapter 122 of
the Monroe County Code. Compliance may require the
structure to be elevated on an approved foundation
above the required design flood elevation.
Additionally, compliance may require the
demolition and replacement of the structure with a
properly elevated structure.
In the case of residential dwelling units, a
letter of ROGO exemption issued by the Planning &
Environmental Resources Department may be
necessary to determine the dwelling unit was
lawfully established and can be replaced. In the
case of nonresidential structures, the Planning &
Environmental Resources Department will review and
determine if the structure can be replaced.
This permit does not authorize native land
clearing or deposition of fill material. If work
is conducted outside of the existing footprint of
the structure, consultation with the U. S. Fish
and Wildlife Service may be required.
This permit does not confer lawful status on any
other uses or improvements that may have been
constructed on this property without benefit of a
permit, and assumes the work conducted is intended
to bring the structure to its preexisting
design/footprint.
The fact that inspections have been conducted in
connection with the scope of this permit may not
be used by the property owner as a defense to any
other unlawful or unpermitted use or improvement
present on the property. There may be development
and/or land use issues on the parcel that are no
longer in compliance with a county regulation(s)
or established unlawfully without the benefit of
proper approvals. Approval of this permit does not
deem all development as conforming or deem
unlawful development as lawful.
The department reserves the right to require that
such development be brought into compliance
through the proper approval process or terminated
upon future discovery.
