COMPLAINANT STATES VIA EMAIL:
"IN FEAR OF REPERCUSSION I CHOOSE TO STAY
ANONYMOUS REGARDING THIS CONCERN. I CURRENTLY LIVE
ACROSS THE CANAL OF 30 PIGEON DRIVE (SEXTON COVE
ESTATE), KEY LARGO WHICH IS THE ADDRESS OF MY
CONCERN. THE OWNERS OF SUCH PROPERTY APPEARED TO
HAVE CONSTRUCTED A HUGH STRUCTURE ROUND THEIR
EXISTING MOBILE HOME WHICH I FEAR IS NOT WITHIN
CODE AND IN THE EVENT OF A WINDSTORM IT CAN CAUSE
SUBSTANTIAL DAMAGE TO THE SURROUNDING HOME
INCLUDING MINE. I FOUND IT ODD THAT MOST OF THE
CONSTRUCTION WAS DONE ON WEEKENDS WHICH GIVES ME
REASON TO BELIEVE THAT THEY WERE CONCEALING THE
CONSTRUCTION AND OBSCURE FROM BEING DETECTED BY
BUILDING OR CODE INSPECTORS. ADDITIONALLY, I’VE
ALSO NOTICED THEY INSTALLED A JACUZZI NEAR THE
CANAL AND I HOPE NONE OF THE CHEMICALS THEY USED
FOR MAINTENANCE HAS BEEN DISCHARGED INTO THE
CANAL."

INITIAL SITE VISIT ON 4/8/13 SHOWS MOBILE HOME WITH
ADDITION(S). APPEARS TO BE STUCCO AND WINDOWS. THE HOT
TUB (JACUZZI) IS SITTING ON WHAT USED TO BE THE BOAT
RAMP, WHICH IS NOW GONE. WILL RESEARCH PERMIT HISTORY
AND ARCHIVE PHOTOS FROM PROPERTY APPRAISER'S OFFICE

MEETING WITH THE PROPERTY OWNER/S IN REFERENCE TO
CLARIFY WHAT IS PERMITTABLE AND WHAT IS PROHIBITED. THE
MEETING WAS HELD WITH CODE, FLOOD, BUILDING AND THE
PLANNING DEPARTMENT STAFF. THE DETERMINATION BY FLOOD
IS AS FOLLOW:
THIS PROPERTY IS LOCATED IN AN AE 10 SPECIAL FLOOD
HAZARD AREA. THE TRAILER WAS PERMITTED PRIOR TO 1975 SO
IT WOULD BE CONSIDERED PRE-FIRM AND WOULD FALL UNDER
THE NON SUBSTANTIAL IMPROVEMENT RULE(50%). HOWEVER ANY
ADDITION TO THE TRAILER WOULD HAVE TO BE FOURTH WALL
CONSTRUCTION(STAND-ALONE) AND WOULD BE REQUIRED TO MEET
ALL CURRENT CODES. ANYTHING THAT WAS ADDED WITHOUT A
PERMIT OR INSPECTIONS CANNOT BE CONSIDERED
NON-CONFORMING(GRANDFATHERED) AS IT IS ILLEGAL . I DO
NOT HAVE AN ELEVATION CERTIFICATE FOR THIS EXACT
PROPERTY SO AS TO DETERMINE THE ELEVATION OF THE
FINISHED FLOOR. I HAVE ONE FOR SEVERAL LOTS DOWN AND
GRADE IS AROUND 4.0 TO 4.5 FEET NGVD. THIS WOULD PUT
THIS PROPERTY AROUND 5 ½ TO 6 FEET BELOW BASE FLOOD. AT
THIS POINT THE OPTIONS FOR COMPLIANCE WITH THE FLOOD
ORDINANCE WOULD BE TO APPLY FOR A PERMIT(DEMOLITION) TO
RETURN THE AREA BACK TO THE CARPORT THAT WAS LEGALLY
PERMITTED OR TO APPLY FOR A PERMIT TO ELEVATE THE
ADDITION TO ABOVE BASE FLOOD ELEVATION OF 10 FOOT
NGVD. FOLLOWING THIS DETERMINATION CODE HAS GIVEN THE
PROPERTY OWNER/S UNTIL 10-01-2013 TO SUBMIT SOME TYPE
OF PERMIT APPLICATION, WHETHER IT'S FOR DEMOLITION
AND/OR ENGINEERING PLANS FOR CONSTRUCTION TO REBUILD.
PROPERTY OWNER/S AGREED.

SITE INSPECTION AND MEET WITH THE

PROPERTY OWNERS AND CONTRACTOR.
