AS PER DIRECTOR, SEND OWNER NOTICE OF VIOLATION FOR THE
UNPERMITTED TIKI HUT. RE-INSPECTION PHOTOS SHOW THE
UNPERMITTED TIKI HAS EXPANDED INTO A FULL BLOWN SPORTS
BAR WITH SEATING (TABLES, CHAIRS, AND BAR STOOLS)
INSIDE TIKI AND OUTSIDE TIKI. TV'S, CASH REGISTER,
ELECTRIC, AND PLUMBING (BAR SINK). APPLIANCES, ETC.
UTILITY TRAILER NEXT TO TIKI AS SEEN IN PHOTOS SHOWS IT
BEING USED AS STORE ROOM FOR BAR SUPPLIES. QUITE ALOT
OF OUTDOOR SEATING. WILL SEND PLANNING DEPT. A REFERRAL
TO INQUIRE ABOUT APPROVAL(S) FOR EXPANSION OF USE.

SENDING NOV WITH MAY 31ST HEARING DATE. CHARGES ARE NO
PERMIT AND NO PLANNING APPROVAL. STATUS OF THE PERMIT
(08303371) FOR THIS TIKI APPLIED FOR ON 9/22/08. WENT
TO PLANNING ON 10/09/08 AND FAILED THE PLANS REVIEW. IT
WENT TO THE PENDING DRAWER AWAITING CORRECTIONS. NO
CORRECTIONS WERE MADE UNTIL 4/12/12. THE PERMIT CAME
OUT OF THE PENDING DRAWER AND STARTED THE PLANS REVIEW
PROCEDURE. IT WENT TO THE FIRE MARSHALL, ELECTRICAL
INSPECTOR, FLOOD PLAIN MANAGEMENT, AND THE PLANS
REVIEWER. **THE PERMIT FAILED ALL THE STOPS EXCEPT

APPROVALS AND AMENDMENT(S) TO THE CONDITIONAL USES,
ETC. LOCATED THE DOCUMENT DATED 5/11/12 WHICH WAS THE
ANSWER TO THE VIOLATIONS REFERRAL FORM FROM CODE TO
PLANNING DATED 3/19/12.
THE DOCUMENT WAS DATED AFTER THE NOTICE OF VIOLATION
WAS PRINTED AND SENT TO MARATHON ON 4/27/12. THEREFORE,
THE CHARGE OF 110-140.(2) HAS BEEN ELIMINATED FROM THE
NOTICE OF VIOLATION, SINCE THE PLANNING DOCUMENT HAS
APPROVED THE SPORTS BAR TIKI HUT. THIS DOCUMENT IS
LOCATED IN THE ATTACHMENT.

THE FIRE MARSHALL HAS ISSUED A HOLD ON THE INSPECTIONS
OF THIS PERMIT DUE TO THE FACT THAT THE RESORT IS USING
THE WALKWAY AS OUTDOOR SEATING WHICH WAS STIPULATED IN
THE CONDITIONS TO THE WALKWAY PERMIT THAT IS WAS NOT TO
BE USED AS DINING AREA. AND NOW THE FIRE MARSHALL IN
REQURING THE OWNER INSTALL SPRINKLER SYSTEM AS
CONDITIONED IN THE PERMIT.

ALL ATTACHED TIKI STRUCTURES (ALL TIKI HUTS AND
WALKWAYS STRUCTURES) SHALL BE PROTECTED BY AN APPROVED,
AUTOMATIC FIRE SPRINKLER SYSTEM PER FLORIDA FIRE
