RECEIVED A COMPLAINT REGARDING INTERIOR
RENOVATIONS TO A DOWNSTAIRS
ENCLOSURE.THIS RESIDENCE WAS BUILT AS A
SINGLE FAMILY RESIDENCE WITH DOWNSTAIRS
ENCLOSURE FOR STORAGE PURPOSES ONLY.IT
IS ON THE TAX ROLE LIKEWISE.ON 01-18-05
INSPECTOR REED AND MYSELF VISITED THE
PROPERTY.WE SPOKE TO THE DOWNSTAIRS
TENNANT A B.TAYLOR.SHE STATED THAT SHE
HAD MOVED IN SOMETIME IN DECEMBER.WHILE
MR. REED AND MYSELF WERE THERE,WE
OBSERVED A FULL APARTMENT.THERE WERE
KITCHEN CABINETS,A
REFRIGERATOR,STOVE,BEDROOM,ENTERTAINMENT
CENTERANDA BATHROOM.THE ENCLOSURE WAS
FULLY FURNISHED.I HAVE SPOKEN TO THE
COMPLAINENT,MR.THOMAS OEHMKE SEVERAL
TIMES.HE STATED THAT HE ATTENDED AN
OPEN HOUSE WHEN THE PROPERTY WAS ON THE
MARKET IN APRIL OR MAY OF 2004.HE
STATED THAT AT THAT TIME THE ENCLOSURE
WAS NOT FINISHED AND WAS NOT BEING USED
FOR HABITATION.HE FURTHER STATED THAT
THE ENCLOSURE CONSITED OF ONE LARGE
ROOM WITH NO PETITION WALLS.THERE WAS
NO KITCHEN AND NO BEDROOM.THE FLOORS
WERE NOT TILED AT THE TIME.HE STATED
THAT HE WOULD BE GLAD TO TESTIFY BEFORE
THE SPECIAL MAGISTRATE REGARDING THE
CONDITION OF THE ENCLOSURE AT THE TIME
OF THE OPEN HOUSE.MR.REED AND MYSELF
WER NOT ALLOWED TO TAKE PICTURES AT THE
TIME OF OUR VISIT.

RECEIVED A LETTER FROM PROPERTY OWNER
MR. MEDEROS .HE STATED THAT THE
DOWNSTAIRS APARTMENT WAS THERE BEFORE
HE PURCHASED IT.HE FURTHER CLAIMED THAT
THE ENCLOSURE HAD ONE BEDROOM,ONE
BATHROOM AND A KITCHENETTE.

RECEIVED A PHONE CALL FROM A MR.EDWARD
FORD WHO OWNES PROPERTY IN THIS
NEIGHBORHOOD.HE STATED THAT HE HAD
VISITED THE PROPERTY WITHIN THE LAST
YEAR AND WOULD TESTIFY THAT THE
ENCLOSURE WAS ONE LARGE ROOM THAT WAS
USED AS A STUDIO FOR ART WORK.HE
FURTHER STATED THAT NO ONE LIVED IN THE
ENCLOSURE.HE SAID THERE WAS NO
BEDROOM,NO KITCHEN,NOR KITCHEN CABINETS
AND NO PETITION WALLS.THE ENCLOSED AREA
WAS UTILIZED BY THE PREVIOUS PROPERTY
OWNERA MR. GUNTHER REISS FOR STORAGE OF
HIS ART.

UPON RECEIVING THE LETTER FROM OSCAR
MADEROS,EXHIBIT #3,I CALLED AND SPOKE
TO HIM.HE CLAIMED THAT HE HAD INSTALLED
TILE FLOORS,KITCHEN CABINETS,A
REFRIGERATOR AND A STOVE.HE CLAIMS THE
BEDROOM AND BATH WERE THERE WHEN HE
BOUGHT THE PROPERTY.HE FURTHER STATED
THAT THE TENANT OF THE DOWNSTAIRS
ENCLOSURE IS NOT PAYING RENT.

11-21-05 - AGREEMENT REACHED AT HEARING
RESPONDENT WILL ADMIT VIOLATION. MR.
MATTSON PRESENTED EVIDENCE THAT THE BED
& BATH HAD BEEN IN THE DOWNSTAIRS
ENCLOSURE SINCE 1982. REMOVAL OF THE
KITCHEN WILL BRING THAT PORTION
OF THE DOWNSTAIRS ENCLOSURE INTO
COMPLIANCE.
BY COMPLIANCE THE AGREEMENT IS THAT THE
FACILITIES IN THE KITCHENETTE, STOVE,
SINK, ETC WILL BE REMOVED. THERE IS A
SEPARATE FEMA ISSUE THAT COULD NOT BE
ADDRESSED AT THE HEARING.
RESPONDENT WAS FOUND IN VIOLATION,
GIVEN UNTIL JANUARY 18TH 2006 TO BE
COMPLIANT.RESPONDENT AGREED TO ACCEPT
THE AGREEMENT IN ALL RESPECTS AND THAT
THE KITCHEN WAS IN VIOLATION. $100
ADMINISTRATIVE COSTS WERE IMPOSED, ALL
OTHER FINES WERE RESERVED.
